INDEMNITY FORM

Hereby agree the Mossel Bay Community Policing Forum (CPF) directors / representatives / employees / members / agents and/or any promoter, organizer, guarantor and/or sponsor of the Mossel Bay Kaskar Race as well as the Mossel Bay Municipality responsible for the road on which the Mossel Bay Kaskar Race is held, shall not be held liable under any circumstance for any damage done by any vehicle or person entered by/driven in or attended upon by me in the Mossel Bay Kaskar Race or for any personal injury-fatal or otherwise or loss of whatever kind (including but not limited to patrimonial and/or non-patrimonial damages) sustained by myself or by any person riding/driving in or attending upon it or any person whatsoever, whether caused during the Mossel Bay Kaskar Race, or while the said vehicle is on any road or area forming part of the track or route or premises, or any deviation therefrom or any approach by whatever means such damage, injury or loss may be caused and even though the same may be contributed to or caused by the negligence or gross negligence of any employee, official, agent or representative of the Mossel Bay Community Policing Forum (CPF) or any promoter, organizer, guarantor or sponsor of the Mossel Bay Kaskar Race or the owner/s of the property on which the Mossel Bay Kaskar Race is held.

I hereby indemnify the Mossel Bay Community Policing Forum (CPF) directors / representatives / employees / members / agents and/or any promoter, organizer, guarantor and sponsor of the Mossel Bay Kaskar Race and the owner/s of any property on which the Mossel Bay Kaskar Race is held against all and any liability for any damage or injury so done or sustained as aforesaid by myself or any other such persons as aforesaid. I further declare that I am aware of the risks, dangers, and perils attendant upon Mossel Bay Kaskar Race racing which I hereby fully assume. This indemnity shall apply to all competitions/practice/event runs in which I take part in any capacity.

WARNING: Kaskar Racing is dangerous. In view of the high speeds attained by the competitors/participants accidents can happen. Mossel Bay Community Policing Forum (CPF), promoters and organizers of the Mossel Bay Kaskar Race and facility cannot guarantee your safety. You are present at your own risk.

I further declare that: I am medically fit to participate. I AM AWARE THAT I AM RESPONSIBLE FOR THE COST OF MEDICAL TREATMENT, and that I am not under the influence of drugs and/or alcohol or any such substance, I am also not pregnant. In case of emergency, I authorize any qualified medical person to treat me.

RULES & CONDUCT

I acknowledge that I understand and will adhere to the Rules & Conduct noted below:

  1. Blocking, weaving, swerving, and bumping is prohibited – only one warning is given thereafter disqualification (with no refund)
  2. Braking later than the brake markers is forbidden and is considered dangerous.
  3. Marshals/Officials/Staff instructions either verbally or by flag/signal are to be always obeyed.
  4. No driving permitted under influence of alcohol, drugs, or any substance.
  5. No driving if pregnant or if you suffer from any serious medical conditions.
  6. Please ensure all head hair is tied up, tucked in, and can't come loose when racing. In the event it does please stop safely immediately and wait for a marshal to attend. No loose items of clothing to be worn whilst driving. Only closed shoes permitted when driving.
  7. Make sure your helmet is always secured – ask a Marshall/staff member to assist if you if necessary.
  8. Please always keep all body parts in the kaskar, and away from any moving parts.
  9. In the event of an accident/emergency or stoppage, wait for assistance from a Marshall.
  10. If you get injured or require any assistance, please inform our staff immediately.
  11. Kaskar racing is dangerous so please show respect to those around you and yourself, as well as to the kaskarre.
  12. We do not refund after the session has started under any circumstance.
  13. Please make sure you don't have loose or sharp objects on you when driving e.g., Keys, Phones, Wallet etc.
